1. DESCRIPTION: The "Black Radiance WIN THE LOOK Sweepstakes" ("Sweepstakes") begins on 02/01/2012 and ends 02/29/2012 ("Sweepstakes Period"). The sponsor and administrator of this Sweepstakes are Markwins Beauty Products, Inc.
2. ELIGIBILITY: Sweepstakes is open to legal residents of the 50 United States and Washington, D.C. who are at least 18 years of age at time of entry. Any individuals (including but not limited to employees, consultants, independent contractors and interns) who have, within the past six months, held employment with or performed services for Sponsors, Sweepstakes Administrator or any organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion of the Sweepstakes (collectively, "Sweepstakes Entities") are not eligible to enter or win. Immediate Family Members and Household Members of such individuals are not eligible to enter or win. "Immediate Family Members" shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. "Household Members" shall mean those people who share the same residence at least three months a year. Void in Puerto Rico and elsewhere outside the 50 United States and Washington, D.C. and where prohibited or restricted by law.
3. HOW TO ENTER: Complete the online entry form in its entirety at the web site [http://www.blackradiancebeauty.com/]. Entries must be received by 02/29/2012. Only one entry per person, per e-mail address is permitted, regardless of method of entry. Any use of robotic automatic, programmed or the like entry methods will void all such entries by such methods. If entries exceed these limits, then only the most recent entry submitted by the same person or with the same e-mail address will be eligible to be considered for potential selection to receive the prize to be awarded hereunder. Entries generated by a script, macro or other automated means will be disqualified. Entrants must provide all information requested to be eligible to win. Incomplete, unreadable, or unintelligible entries will be disqualified. All information provided by entrants becomes the property of Sponsors. Entries will not be acknowledged or returned.
4. PRIZES: There will be1 winner. The prize is a beauty collection of Black Radiance worth of retail value $75.00. The value of the prize set forth above represent Sponsor’s good faith determination of the approximate retail value(s) thereof; the actual fair market value(s) as ultimately determined by Sponsor are final and binding and cannot be challenged or appealed. In the event the stated approximate retail value of a prize is more than the actual fair market value of that prize, the difference will not be awarded in cash or otherwise. No substitution or compensation will be given for any portion of the prize that is not used. Odds of winning depend on the number of eligible entries received.
5. WINNER SELECTION AND NOTIFICATION: Winner will be determined by random drawing from all eligible entries received, to be held on or about 03/15/2012 at the Sponsor's offices. All decisions of the Sponsor are final and binding. Winner will be notified by telephone and/or email within approximately five (5) days of the drawing date. Selected winners will be required to respond (as directed) to the notification within seventy two (72) hours of first attempted notification. The failure to respond timely to the notification may result in forfeiture of the prize and, in such case, Sweepstakes Administrator will select randomly an alternate winner from among the remaining eligible entries. If the prize is not awarded after up to three (3) alternate winners have been notified, the prize may not be re-awarded, in Sponsors’ sole discretion. In the event that a winner is less than the age of majority under applicable state law, the parent or legal guardian of such winner will be required to sign all documents required hereunder and Sponsors reserve the right to award such minor’s prize to, and in the name of, such parent or legal guardian.
6. CONDITIONS OF PARTICIPATION/RELEASES: Sweepstakes is void where prohibited or restricted by law. All federal, state and local laws and regulations apply. By participating, each entrant agrees to be bound by these Official Sweepstakes Rules and the decisions of the Sponsors and the Sweepstakes Administrator, which shall be final and binding in all respects. By participating in this Sweepstakes and/or by accepting any prize that they may win, each entrant agrees to release the Sponsors and Sweepstakes Administrator; each of their respective parent, subsidiary and affiliated companies, units and divisions and advertising and promotional agencies and prize suppliers; each of their respective officers, directors, agents, representatives and employees; and each of these companies and individuals' respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Sweepstakes and/or acceptance or use of the prize. Notwithstanding the foregoing, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, Sweepstakes entrant agrees that, by entering the Sweepstakes, (i) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney’s fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses. Each entrant authorizes the Released Parties to use his/her name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material, worldwide in perpetuity, or on a winner's list, if applicable, without further compensation unless prohibited by law. Sponsors are not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsors’ sole discretion, without further obligation or compensation. The Released Parties shall not be liable for: (i) late, lost, delayed, stolen, misdirected, incomplete, unreadable, inaccurate, postage due, garbled or unintelligible entries, communications or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Sweepstakes; or (v) any printing, typographical, human administrative or technological errors in any materials associated with the Sweepstakes. Sponsors disclaim any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Sweepstakes. Sponsors reserve the right, in their sole discretion, to cancel, modify or suspend the Sweepstakes (or any portion of the Sweepstakes) should a virus, bug, computer problem, unauthorized intervention or other cause or problem corrupt or inhibit the administration, security or proper play of the Sweepstakes and, in such situation, to select the winner from eligible non-suspect entries received prior to and/or after such action or in such manner as deemed fair and appropriate by Sponsors. Sponsors may prohibit you from participating in the Sweepstakes or winning a prize if, in their sole discretion, they determine you are attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other players or Sponsors’ representatives. This Sweepstakes will be governed by the laws of the State of California. Any and all legal actions or claims arising in connection with this Sweepstakes must be brought in a court of competent jurisdiction within the United States.
